Fair use is a legal doctrine under U.S. copyright law (17 U.S.C. § 107) that allows limited use of copyrighted material without requiring permission from the rights holder. Courts evaluate fair use based on four factors: the purpose and character of the use (including whether it is commercial or transformative), the nature of the copyrighted work, the amount used in relation to the whole, and the effect on the market for the original work.
ClipSpeedAI provides automated video processing tools including clipping, captioning, reframing, and viral scoring. We do not determine whether any specific use of content constitutes fair use. That determination is a legal question that depends on the specific circumstances of each case.
Many content creators who clip livestreams add commentary, reaction, criticism, or educational context to their clips — which courts have recognized as potentially transformative. However, simply re-uploading unmodified clips without any transformative element is less likely to qualify as fair use. We strongly encourage all users to add their own commentary, analysis, or creative transformation to any clips they create.
By using ClipSpeedAI, you acknowledge and agree that you are solely responsible for all content you create, share, and distribute. This includes ensuring that your clips comply with copyright law, do not contain or promote illegal content, do not violate platform terms of service, do not infringe on any third party's rights, do not contain defamatory, harassing, or harmful material, and comply with all applicable local, state, national, and international laws.
Live streamers on platforms like Kick, Twitch, and YouTube may broadcast content that includes mature themes, explicit language, controversial opinions, gambling, or other sensitive material. ClipSpeedAI does not monitor, filter, or moderate the content of source videos. Users who clip streamer content are responsible for reviewing what they clip and ensuring it is appropriate for their intended audience and platform.
Some streamers may be banned or suspended from platforms due to violations of those platforms' rules. Clipping content from banned streamers may carry additional risks. Users should exercise their own judgment about which content to clip and distribute. ClipSpeedAI is not responsible for the actions, statements, or status of any streamer whose content is processed through our platform.
If you monetize clips created with ClipSpeedAI (through ad revenue, sponsorships, or any other means), you are solely responsible for ensuring that such monetization complies with all applicable laws and platform policies. ClipSpeedAI does not receive any portion of user monetization revenue and bears no responsibility for monetization disputes.
